​​1. About this website and these terms

This website at www.bce.systems, together with its regional sections and associated subdomains, is operated by BCE Systems Limited, a private limited liability company incorporated in Kenya under company number PVT-7LU3DY6. Our registered office is The Address, 7th Floor, Muthangari Drive, Nairobi, Kenya. In these terms, “BCE”, “we”, “us”, and “our” mean BCE Systems Limited unless a page, quotation, order, or notice identifies another entity.

By accessing or using the website, you agree to these Website Terms. If you do not agree, do not use the website. Separate terms apply to orders, recruitment, privacy, cookies, subscriptions, support services, and third-party platforms.

​​2. Information, quotations, and contracts

Website content is general information about our systems, services, and solutions. It is not technical, legal, security, regulatory, or procurement advice. Unless a page expressly says otherwise, content is not an offer capable of acceptance and is not a warranty that a product is available, approved, interoperable, or suitable for a particular purpose.

Specifications, illustrations, configurations, lead times, pricing, certifications, partner status, and availability may change. BCE will confirm the terms that apply in a written quotation, order acceptance, subscription confirmation, statement of work, or contract. An online order is governed by the Commerce Terms and the information presented at checkout.

If a system is subject to spectrum licensing, type approval, import approval, export control, end-use restrictions, site permissions, or another regulatory requirement, responsibility will be allocated in the relevant quotation or contract. No website statement removes an obligation imposed by law.

​​3. Permitted use

You may view, download, and print website material for lawful internal evaluation or procurement, provided that you do not alter it and retain all proprietary notices.

You must not:

use the website unlawfully, fraudulently, or in a way that infringes another person’s rights;

obtain or attempt unauthorised access to the website, a user account, a server, or a connected system;

introduce malware, interfere with availability, test security without written authority, or conduct a denial-of-service attack;

scrape, systematically extract, republish, frame, resell, or create a database from substantial website content without written permission;

reverse engineer website code except to the limited extent that applicable law cannot validly prohibit it;

use website content, catalogues, or data to train or develop a competing product or commercial dataset without written permission;

remove rights notices or misrepresent the source, date, approval, or context of content; or

claim an affiliation with BCE, a manufacturer, or a partner programme that has not been authorised in writing.

Unauthorised access and interference may be offences under the Computer Misuse and Cybercrimes Act, Cap. 79C, in addition to giving rise to civil remedies.

​​4. Intellectual property

Unless otherwise stated, BCE or its licensors owns the website and its original text, design, graphics, software, and other content. These terms grant only the limited use permission in section 3. They do not transfer any intellectual-property right or grant a licence to use BCE’s name, logo, slogans, domain names, or other marks.

Third-party names, product information, images, and marks belong to their respective owners. Their display is subject to the Legal Notices and any applicable permission or partner authorisation.

​​5. Third-party content and services

The website may link to or display services operated by other organisations, including product showcases, payment services, billing, recruitment, helpdesk, mapping, video, and social platforms. A link or integration does not by itself mean that BCE controls or endorses all third-party content.

Third-party terms and privacy notices may apply when you choose to use those services. BCE is responsible for its own acts and obligations but is not responsible for a third party’s independent content, systems, or conduct to the extent permitted by law. Optional embeds and tracking technologies are governed by the Cookie Policy and should remain blocked until the required consent is given.

​​6. Regional operations and contracting entity

BCE works across Kenya, Somalia, and other regional markets. Some regional services may be offered by BCE Systems (Somalia) or another entity identified in the relevant quotation, order, invoice, or service notice. The identified contracting entity, not the shared brand presentation alone, determines the contract, invoicing responsibility, and applicable supplemental terms.

These Website Terms are governed by Kenyan law in relation to BCE Systems Limited. Mandatory laws in the place where a service is supplied, a consumer resides, or data is processed may also apply and are not excluded.

​​7. Website availability and security

We use reasonable measures to operate and protect the website, but we do not promise uninterrupted, error-free, or vulnerability-free access. We may suspend or change all or part of the website for maintenance, security, legal, or operational reasons.

You are responsible for using suitable devices, current software, and reasonable security precautions. If you discover a suspected vulnerability, report it responsibly to bce@ke.bce.systems and do not exploit it, access unnecessary data, disrupt services, or publicly disclose details before BCE has had a reasonable opportunity to investigate and address the issue.

​​8. Privacy and cookies

We process personal data as described in the Privacy and Data Protection Notice. The Cookie Policy and Preferences explains the cookies and similar technologies used by the website and how to change consent choices.

​​9. Disclaimers and liability

Nothing in these terms excludes, restricts, or modifies a right or remedy that cannot lawfully be excluded, including applicable consumer rights and obligations under data-protection law. Nothing excludes liability for fraud or fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or another liability that the law does not permit us to exclude.

Subject to the preceding paragraph, BCE does not warrant the accuracy or completeness of general website content and is not liable for a decision made solely in reliance on that content. To the fullest extent permitted by law, BCE is not liable under these Website Terms for indirect or consequential loss, or for loss of profit, business, opportunity, anticipated saving, goodwill, or data, arising only from free use of the public website.

This section does not replace the liability terms in a quotation, order, or contract and does not reduce BCE’s responsibility for its own contractual commitments.

​​10. Changes

We may update these terms by publishing a revised version. A revision applies to website use after publication. It does not retroactively change a contract already formed unless the contract and applicable law permit that change.

​​11. Disputes and governing law

Before starting ordinary court proceedings about these Website Terms, each party should give written notice of the issue and allow at least 14 days for good-faith discussion. If the matter is not resolved, the parties should attempt mediation in Nairobi before a mutually agreed accredited mediator. This does not prevent urgent interim relief, the protection of intellectual property or confidential information, a complaint to a regulator, or exercise of a non-excludable consumer right.

These terms are governed by the laws of Kenya. Subject to any mandatory right to bring a claim elsewhere, the courts of Kenya have jurisdiction.
